You must read and agree to the Subscriber Agreement and conditions before you can use Airport Media, Inc. (AirportWorker.com). Please read them completely.

AirportWorker provides subscription services, providing site visitors and Subscribers with access to airport and aviation employment information. Our services and solutions include searchable job postings, resume databases, recruitment media solutions throughout our network, and other career-related content. Job seekers can search for job postings and post a resume on each of our career websites for a fee. Companies pay to post jobs, search our resume database, and utilize career site hosting and other services. We’ve put together some detailed terms and conditions. You should read and understand them as they govern your use of our service.

These Terms of Use are also a resource for you to get a deeper understanding of how our service works, including the kinds of data we collect, the way we bill, how we interact with you, and other useful details about our services. We encourage you to revisit these Terms of Use when you have a question about the service or want to know how something works. For your convenience, we’ve indexed the Terms of Use, so you may easily navigate and access areas of interest. We hope you enjoy your AirportWorker experience.

You must read and agree to the Airport Media, Inc. Terms of Use before you can use Airport Media, Inc. (AirportWorker.com) as they govern your use of our site and services. Please read them completely. The AirportWorker service is provided by Airport Media, Inc., or one of its affiliated companies.

These Terms of Use, inclusive of our Privacy Policy and End User License Agreement (“EULA”), govern your use of the AirportWorker service, including all features and functionalities, email service, our website, and user interfaces, and all content and software associated therewith the AirportWorker service. By visiting, browsing, or using the AirportWorker service, you accept and agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, you should not use the AirportWorker service, including our website and user interfaces.

By using and visiting the AirportWorker.com website, you acknowledge and agree that (1) You have read the Terms of Use; (2) You understand it; (3) you are bound by the Terms of Use; and (4) AirportWorker might update Terms of Use at any time. As used in these Terms of Use, “AirportWorker service,” “our service,” or “the service” means the service provided by AirportWorker. AirportWorker is providing the service to you (referred to as “AirportWorker” in these Terms of Use) and with whom you are entering into this agreement.

YOU HEREBY ACKNOWLEDGE AND REPRESENT THAT YOU KNOW AND UNDERSTAND THAT THE MATERIALS PRESENTED AT, AND/OR DOWNLOADABLE FROM, THE WEBSITE INCLUDE EXPLICIT FEE-BASED AND MEMBER-SPECIFIC MATERIAL, VISUAL, AND/OR TEXTUAL DEPICTIONS; THAT YOU ARE FAMILIAR WITH MATERIALS OF THIS KIND; THAT YOU ARE AWARE THAT THEY ARE FEE-BASED AND MEMBER SPECIFIC MATERIALS; AND THAT BY AGREEING TO THESE TERMS OF USE YOU ARE WARRANTING TO THE COMPANY THAT YOU ARE INTENTIONALLY AND KNOWINGLY SEEKING ACCESS TO SUCH EXPLICIT FEE BASED AND MEMBER SPECIFIC MATERIALS FOR YOUR OWN PERSONAL VIEWING AND EDUCATIONAL PURPOSES ONLY.

Changes to Terms of Use

AirportWorker reserves the right, from time to time, with or without notice to you, to change these Terms of Use, including the Privacy Policy and EULA, at our sole and absolute discretion. The most current version of these Terms of Use can be reviewed by visiting our website and clicking on “Terms of Use” located at the bottom of the pages of the AirportWorker website. The most current version of the Terms of Use will supersede all previous versions. We will endeavor to post the prior version(s) on our website when the Terms of Use are updated.

Privacy and Communications Preferences

Any personally identifying information submitted through the AirportWorker service is subject to our Privacy Policy, the terms of which are incorporated herein. Please review our Privacy Policy to understand our practices. The date of any changes to our Privacy Policy will be noted at the bottom of the policy.

By using the AirportWorker service, you consent to receive electronic communications from us. For example, AirportWorker may send you newsletters about new AirportWorker features, special offers, promotional announcements, and customer surveys via email or other methods. Communications may also include transactional communications from us about your account (e.g., past due balance, change in Payment Method, confirmation emails, and other transactional information) and information concerning or related to our service. These communications are part of your relationship with AirportWorker. You agree that any notice, agreements, disclosure, or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing. If you no longer want to receive non-transactional communications from us, simply click on the unsubscribe link in our email communications. Please review our Privacy Policy for further details on our marketing communications.

General Billing

Purchase and usage of AirportWorker products and services constitute the customer’s acceptance of AirportWorker’s billing policy. Following is AirportWorker’s billing policy with which all customers must comply.

You can find the specific billing details regarding your service with AirportWorker at any time by logging into your account and clicking on the “My Account” link.

As used in these Terms of Use, “billing” or “billed” shall indicate either a charge or debit, as applicable, against your Payment Method. By starting your AirportWorker service, you are expressly agreeing that we are authorized to charge you a membership fee at the then current rate for the service plan you select, and any other charges you may incur in connection with your use of the AirportWorker service can be applied to the Payment Method on file. Please note that prices and charges are subject to change with notice. The service fee will be billed at the beginning of the paying portion of your membership and each billing cycle thereafter unless and until you cancel your service using the appropriate cancellation procedure as described in the Cancellation section of these Terms of Use.

You acknowledge that the amount billed for services may vary for reasons that may include differing amounts due to promotional offers and/or changing, upgrading, or downgrading your account type or service plan, and you authorize us to charge your Payment Method for such varying amounts, which may be billed in one or more charges.

All accounts are set up on a prepaid basis. Payment must be received by AirportWorker before any billable product or service is provided or activated. Customers are required to keep valid credit card details on file to charge for recurring service fees and additional fees as necessary. Recurring billing is not based on usage. Customers are responsible for keeping all credit card details and contact information current. This can be done by logging into your account and clicking “My Account” and then “Update Billing Info.” All recurring service fees are automatically charged to the credit card on file. Receipts are available to customers upon request.

For certain Payment Methods, the issuer of your Payment Method may charge you a foreign transaction fee or related charges. Check with your bank and credit card issuers for details.

Payment Method

AirportWorker services are to be paid by credit card. Payment by any other means, such as by check, is on a per-customer basis and must be agreed to by AirportWorker. Checks must be paid in U.S. dollars and issued from a U.S. bank. AirportWorker currently accepts American Express, Discover, Visa, MasterCard, and JCB credit cards.

Billing Cycle

  • Credit Card Billing: Your credit card Payment Method will automatically be charged on your specific billing cycle according to your account type and service plan. You remain responsible for any uncollected amounts due to expiration, insufficient funds, or otherwise. You are responsible for providing updated and valid credit card Payment Method information and authorizing us to continue billing the Payment Method for any uncollected amounts due. AirportWorker will attempt to charge the card on file for 30 days.
  • Credit Card Expiration Date: Customer agrees to keep complete and valid credit card billing details on file. Credit card expiration is not a valid form of service cancellation. Failure to keep valid credit card and billing details on file may result in additional fees.
  • Late Fee: All accounts 10 days past due may be assessed a late fee. No fewer than 2 attempts to contact the customer via email and postal mail using the address information on file will be made before a late fee is assessed.
    • Delinquent Accounts: All accounts 30 days past due may be disabled until the balance is paid in full. When disabled, access may be suspended, and data may be unavailable. AirportWorker will continue to treat this as an open account, and the billing cycle will continue, resulting in a past-due account that may be turned over to a third-party collection service. After an account is delinquent for 60 days, it may be submitted to a third-party collection service.

Service Billing

By purchasing a service requiring regular payments, the customer authorizes AirportWorker to charge the Payment Method on file at the service plan interval and in the amount selected by the customer during the purchase process. You agree that the credit card specified for recurring payments to AirportWorker is, and will continue to be, an account that you own and that you will maintain sufficient availability under your credit card limit or sufficient funds in the account linked to your credit card, as applicable, to pay recurring payments.

Payments are collected at the beginning of each billing period and will continue according to the Terms of your account type and Service Plan until you cancel service as described in the Cancellation section of these Terms of Use, or we terminate it. Your account will be charged no more than 24 hours prior to the expiration of the current subscription period. If you do not wish to continue your service, you must self-cancel your service before it renews in order to avoid billing your service plan membership fees to your Payment Method.

Fees

  • Late Fee: AirportWorker may assess a $35.00 late fee for accounts 10 days past due.
  • Administrative Processing or Maintenance Fee: AirportWorker may assess a $10.00 administrative processing or maintenance fee if you fail to meet the self-cancellation service commitment as described in the Cancellation section of these Terms of Use or if AirportWorker cancels your service due to a breach of AirportWorker Terms of Use or for special handling of an outstanding balance. Your account may also be charged this fee if you fail to submit adequate payment of an outstanding balance and your account becomes delinquent.
  • Early Termination Fee: AirportWorker reverses the right to assess an early termination fee of 10% on any quarterly, biannual or annual billing service plans of any kind.
  • Chargebacks: If a customer initiates a chargeback, AirportWorker may assess a $50.00 processing fee for each individual chargeback.
  • Returned Checks: AirportWorker may assess a $50.00 processing fee on all returned checks.
  • Collections Fee: AirportWorker may assess a 35% collections fee to any outstanding account balance that is turned over to a third-party collections service.
  • Interest: Any invoice not paid when due is subject to interest at a rate equal to the lesser of:
    • (i) one and one-half percent (1.5%) per month; or
    • (ii) the maximum interest rate allowed by applicable law.

AirportWorker sends duplicate copies of balance-due notifications via email only as a courtesy and does not accept, acknowledge, read, process or respond to email replies or messages regarding outstanding balances. Any response you provide is required to be in writing via US Postal Mail.

Refund Policy

All sales of services are final and are nonrefundable.

No refunds are given for services rendered, “no shows,” or “non-use” of services. Services, fees, and recurring payments are non-refundable and are not prorated. Membership fees are non-refundable (except as required by applicable law). Any set-up fee and/or promotional rates offered are non-refundable.

AirportWorker offers and provides service for a fee. Once job postings and resumes have been submitted, published, distributed, etc., AirportWorker takes no responsibility for job posting and resume copy, responses, or any lack of response. Prices offered may change at any time, and the Terms of Use do not provide price protection or refunds in the event of a price reduction or promotional offering.

If AirportWorker technical problems prevent or unreasonably delay delivery of your service, your exclusive and sole remedy is replacement or extension of the service, as determined by AirportWorker.

Billing Disputes

Billing disputes are handled by AirportWorker, and filing any chargebacks and/or disputes does not waive or relieve you of any balance due. When filing chargeback and/or dispute(s), AirportWorker may collect on the rendered services and any fees associated with those disputes. Regardless of the outcome of the chargeback, AirportWorker retains the right to collect on any rendered services or fees that are due and may submit any disputed amounts to a third-party collection agency. Once a chargeback has been received, AirportWorker will deactivate the account.

Invoice Payment

Use of Airport Media, Inc. products and services constitutes your acceptance of AirportWorker General Billing policies. All customers must comply. All accounts and services are set up on a prepaid basis. Payment must be received by AirportWorker before any billable product or service is provided or activated. Any invoice not paid when due is subject to interest at a rate equal to the lesser of: (i) one and one-half percent (1.5%) per month or (ii) the maximum interest rate allowed by applicable law. In the event of cancellation, AirportWorker will not prorate any portion of unused product or service fees, and all outstanding invoices must be paid in full. Cancellation does not dismiss outstanding invoices. At the time of cancellation, any outstanding balance must be settled. All canceled accounts with an outstanding balance may be automatically turned over to a third-party collection service, at which time a 35% collections fee will be applied to the outstanding balance. AirportWorker does not accept partial payments on invoiced products and services unless first agreed to in writing by AirportWorker.

Billing

By starting your AirportWorker membership, you are expressly agreeing that we are authorized to charge you a monthly membership fee at the then current rate and any other charges you may incur in connection with your use of the AirportWorker service to the Payment Method you provided during registration (or to a different Payment Method if you change your account information). Please note that prices and charges are subject to change with notice. As used in these Terms of Use, “billing” shall indicate either a charge or debit, as applicable, against your Payment Method. The membership fee will be billed at the beginning of the paying portion of your membership and each month thereafter unless and until you cancel your membership. Visit our website and click on the “Membership Terms and Details” link on the “Your Account” page to see the commencement date for your next renewal period. We automatically bill your Payment Method each month on the calendar day corresponding to the commencement of your paying membership. Membership charges are fully earned upon payment. In the event your paying membership begins on a day not contained in a given month, we bill your Payment Method on the last day of such month. For example, if you started your AirportWorker membership or became a paying member on January 31st, your next payment date is February 28th and your Payment Method would be billed on that date. You acknowledge that the amount billed each month may vary from month to month for reasons that may include differing amounts due to promotional offers and/or changing or adding a plan, and you authorize us to charge your Payment Method for such varying amounts, which may be billed monthly in one or more charges. For certain Payment Methods, the issuer of your Payment Method may charge you a foreign transaction fee or related charges. Check with your bank and credit card issuers for details.

If you are eligible and have signed up for a free trial, your Payment Method will be authorized for up to approximately one month of service during free trials; however, no charges will be made against the Payment Method unless you do not cancel prior to the end of your free trial period. We may also periodically authorize your card in anticipation of membership or related charges. Membership fees and charges are fully earned upon payment. PAYMENTS ARE NONREFUNDABLE, AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODS. At any time and for any reason, we may provide a refund, discount, or other consideration to some or all of our members (“credits”). The amount and form of such credits and the decision to provide them are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future under any circumstance. We may change the fees and charges in effect or add new fees and charges from time to time, but we will give you advance notice of these changes by email. If you want to use a different Payment Method or if there is a change in Payment Method, such as your credit card validity or expiration date, you may edit your Payment Method information by visiting our website and clicking on the “Your Account” link, available at the top of the pages of the AirportWorker website. If your Payment Method reaches its expiration date and you do not edit your Payment Method information or cancel your account (see “Cancellation” below), you authorize us to continue billing that Payment Method and you remain responsible for any uncollected amounts.

Ongoing Membership

Your AirportWorker membership, which may start with a free trial portion, will continue unless and until you cancel your membership or we terminate it. You must cancel your membership before it renews each billing period in order to avoid billing of the next period’s membership fees to your Payment Method. We will bill the monthly membership fee to the Payment Method you provide to us during registration (or to a different Payment Method if you change your account information). Membership fees are fully earned upon payment.

Cancellation

Ongoing Membership and Cancellation

Your AirportWorker membership will continue in effect unless and until you cancel your membership or subscription or the account or service is otherwise suspended or discontinued pursuant to these Terms. You must cancel your subscription before it renews each Billing Period in order to avoid the next billing.

You may cancel your AirportWorker service at any time. Your account and service will remain open until you cancel using the appropriate cancellation method required for your account/service type, as indicated below.

Applicant/Job Seeker/Candidate Services: AirportWorker is a self-service system, and it is required that service is self-canceled by logging into your account and completing and submitting the secure self-cancellation form. By submitting the secure self-cancellation form, service will be canceled, your future automatic recurring payments will be stopped, and you and AirportWorker will have a proper record of your time and date-stamped cancellation request. After receiving the on-screen, time, and date-stamped cancellation confirmation, your resume will be removed from the active applicant pool, and AirportWorker will no longer promote you as an active applicant. If you have not been presented with the on-screen confirmation page, you have not completed the self-cancellation process, and your account will remain open and active until the process is complete and on-screen cancellation confirmation is presented. There are no administrative fees when cancellation is submitted using the self-cancellation form provided inside your account. Due to large volumes of bulk, spam, and junk email, service cancellations are not processed via email, through the AirportWorker Help Desk, or by phone.

You may retrieve your login credentials on the Applicant Sign In web page 24 hours a day, 7 days per week, so that you may securely close your account at any time.

Employer/Recruiter/Company/Agency Services: Service must be self-canceled verbally through an AirportWorker representative via phone. You must notify AirportWorker of your intent to cancel by phone at least five (5) business days prior to your next recurring payment due date. Email requests to cancel do not constitute acceptance of any cancellation. It is imperative that service cancellation is done by speaking with an AirportWorker representative to ensure account closure and only verbal requests made with an AirportWorker representative will generate a cancellation request, stop future automatic recurring payments, cancel the service, and close out an account. All cancellations are confirmed via email. Due to large volumes of bulk, spam, and junk email, service cancellations are not processed via email, through the AirportWorker Help Desk, or by phone.

All advertising product and/or service sales are final and are nonrefundable. In the event of cancellation, AirportWorker will not prorate any portion of unused service fees, and all outstanding balances and/or invoices must be paid in full. We do not provide refunds or credits for any partial service periods. “Non-use” of services does not constitute cancellation. Cancellation of service does not dismiss any outstanding balance or invoice. Closing an account with AirportWorker cannot be done by simply canceling the credit card or stopping recurring payments through your credit card or bank. AirportWorker will continue to treat the account as open, and the billing cycle will continue, resulting in a past-due account that may be turned over to a third-party collection service.

Right to Terminate

We reserve the right to terminate or restrict your use of our service without notice for any or no reason whatsoever.

Free Trials

Your AirportWorker service may start with a promotional free trial period. The free trial period of your service lasts for the time frame specified during sign-up. FREE TRIALS MAY NOT BE COMBINED WITH ANY OTHER DISCOUNTS OR PROMOTIONS WITHIN A 12-MONTH PERIOD. You must have Internet access and a valid Payment Method as indicated during sign-up to use our service. If you or another member of your household has been an AirportWorker member within the last 12 months, or if your Payment Method, physical address, or email address have been associated with an AirportWorker account, or if you are receiving service on a different AirportWorker account, you are not eligible to receive a free trial and your billing period will begin immediately.

We will begin billing your Payment Method for service fees associated with your account type and Service Plan at the end of the free trial period unless you cancel prior to the end of the free trial period as per the Cancellation section of these Terms of Use. To view the specific details of your account type and Service Plan, including the price and end date of your free trial period, log into your account and click the “My Account” link. Your Payment Method will be authorized for up to approximately one month of service as soon as you register. In some instances, your available balance or credit limit may be reduced to reflect the authorization; however, no charges will be made against the Payment Method unless you do not cancel prior to the end of your free trial period. You will not receive a notice from us that your free trial period has ended or that the paying portion of your service has begun. If you cancel prior to the end of your free trial, there will be no charges to your Payment Method. We will continue to bill your Payment Method according to the Terms of your account type and Service plan until you cancel. You may cancel your service at any time; however, there are no refunds or credits for partially used periods.

We may offer a number of account types and service plans, including special promotions or memberships with different limitations. Some of these promotional offers are provided by third parties in conjunction with the provision of their own products and services. We are not responsible for the products and services provided by such third parties. We reserve the right to modify, terminate or otherwise amend our offered account types and service plans.

If you have signed up for a free trial promotion, your Payment Method will be authorized for up to approximately one month of service during free trials; however, no charges will be made against the Payment Method unless you do not cancel prior to the end of your free trial period. We may also periodically authorize your card in anticipation of membership or related charges. Membership fees and charges are fully earned upon payment. Payments are nonrefundable, and there are no refunds or credits for partially used periods. At any time and for any reason, we may provide a refund, discount, or other consideration to some or all of our members in the form of credits. The amount and form of such credits and the decision to provide them are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future under any circumstance. We may change the fees and charges in effect or add new fees and charges from time to time, but we will give you advance notice of these changes by email. If you want to use a different Payment Method or if there is a change in Payment Method, such as your credit card validity or expiration date, you may edit your Payment Method information by logging into your account and clicking on the “My Account”, “Update Billing Info” links. If your Payment Method reaches its expiration date and you do not edit your Payment Method information or properly cancel your account according to the Cancellation section in these Terms of Use, you authorize us to continue billing that Payment Method, and you remain responsible for any uncollected amounts.

Promotional Pricing and Discounts

AirportWorker offers a multitude of promotional pricing and discounts, and you are only eligible to take advantage of one discount or promotion per twelve (12) months. Any claims submitted prior to the wait time will be denied and notified to wait the required additional time until such that twelve (12) months have passed.

How Our Hosting Service Works

AirportWorker is a subscription service providing its customers with access to job postings, resume & email hosting over the Internet. These job postings, resumes & emails are created by entities other than AirportWorker.

We reserve the right in our sole and absolute discretion to make changes from time to time and without notice in how we operate our service. Any description of how our service works should not be considered a representation or obligation with respect to how the service will always work. We are constantly making adjustments to our service, and often, these adjustments are not completely captured within these Terms of Use.

  • Availability: The availability of job postings, resumes & email volume will change from time to time and from region to region. The quality and quantity of the job postings, resumes, or emails may vary and may be affected by a variety of factors, such as your location, the economy and other external factors beyond the control of AirportWorker. You are responsible for all Internet access charges. Please check with your Internet provider for information on possible Internet data usage charges. AirportWorker makes no representations or warranties about the quality of your Internet quality or speed. You may cancel your AirportWorker account at any time by following the Cancellation section of these Terms of Use.
  • Personal Computer Requirements and Device Limitations: To enjoy AirportWorker via your personal computer, your equipment must satisfy certain system requirements. YOU WILL BE ALLOWED TO USE AirportWorker ON ONE SUCH DEVICE AT ANY GIVEN TIME. The number of devices and concurrent use may change without notice to you. For certain membership plans, you may be limited to personal computers.
  • Geographic Limitation: You may use the AirportWorker service only in geographic locations where we offer our service and have licensed such use. The content that may be available to view will vary by geographic location. AirportWorker will use technologies to verify your geographic location.
  • AirportWorker Hosting Software: AirportWorker hosting software is developed by, or for, AirportWorker and is designed to enable the hosting of content from AirportWorker provided by AirportWorker users. This software may vary by device and medium, and functionalities may also differ between devices. This software is licensed to you by AirportWorker pursuant to these Terms of Use and solely for the purpose of using the AirportWorker service and for no other purpose whatsoever. WE DO NOT WARRANT THE PERFORMANCE OF THIS SOFTWARE, INCLUDING ITS CONTINUING COMPATIBILITY WITH OUR SERVICE. Please refer to the Disclaimers of Warranties and Limitations of Liability set forth in these Terms of Use. You may not copy or reproduce the software or content, nor may you decompile, reverse engineer, disassemble, modify, or create derivative works of any of the software or content or any portion thereof. Any unauthorized use of the software or content is strictly prohibited, and AirportWorker reserves the right to not provide the software (including updates) to you at any time and to discontinue the ability to access the AirportWorker service through such software at any time without prior or any notice.

AirportWorker is not an employment agency, and no guarantee of employment is expressed or implied. This service is designed to provide information with regard to the subject matter covered. The information has been contributed by potential employers and candidates and is not necessarily certified or endorsed by Airport Media, Inc., its employees, agents, officers, third-party suppliers, or contractees. No warranty of accuracy is expressed or implied.

This service is no guarantee of job offers, employment, or a successful recruiting campaign and is provided for users to post and view job openings and resumes, prepare for aviation industry employment, and for your entertainment pleasure only. All information contributed to this system becomes the property of Airport Media, Inc. (AirportWorker.com) to publish and use in any fashion, be it print, web, social media, electronic mail, etc.

The service is sold with the understanding that Airport Media, Inc. is not engaged in rendering legal, accounting, or other professional advice. If legal advice or other expert professional assistance is required, the services of a competent professional person should be sought.

END USER LICENSE AGREEMENT: BY USING OUR SERVICE, YOU ACKNOWLEDGE AND AGREE (1) TO THE AirportWorker SOFTWARE END USER LICENSE AGREEMENT FOUND HERE AS SUCH MAY BE AMENDED OR ADDED TO FROM TIME TO TIME AND (2) TO RECEIVE, WITHOUT FURTHER NOTICE OR PROMPTING, UPDATED VERSIONS OF THE AirportWorker AND RELATED THIRD-PARTY SOFTWARE. IF YOU DO NOT ACCEPT THE FOREGOING TERMS, DO NOT USE OUR SERVICE. We do not warrant that any of the software used and or licensed in connection with our service will be compatible with other third-party software, nor do we warrant that the operation of our service and the associated software will not damage or disrupt other software or hardware. AS SUCH, WE DO NOT TAKE RESPONSIBILITY OR OTHERWISE WARRANT THE PERFORMANCE OF THESE DEVICES, INCLUDING THE CONTINUING COMPATIBILITY OF THE DEVICE WITH OUR SERVICE. By using our service, you agree to look solely to the entity that manufactured and/or sold you the device for any issues related to the device and its compatibility with the AirportWorker service. Social Media

The compilation of all content, job postings, resumes, or other materials provided in connection with the AirportWorker service are the exclusive property of AirportWorker and its licensors. AirportWorker reserves the right in our sole and absolute discretion to share content or other material for promotional or other purposes through social media, including but not limited to Facebook, Twitter, LinkedIn, YouTube, and any and all social media and sharing made available through our website or services.

Member Reviews and Public Comments

We permit you to post reviews of job postings, resumes & email correspondence available through the AirportWorker service. We do not regularly review the job postings, resumes, or email (content) posted on the AirportWorker website; however, we reserve the right to reject, remove, or edit such content at any time without notice. Reviews should not be posted that contain harsh, profane, or discriminatory language; illegal, obscene, threatening, defamatory, or otherwise objectionable content; URLs, phone numbers, mailing or email addresses, personal attacks on the applicant or company or its personnel; misleading information; or a discussion of AirportWorker policies or services. Please click on the “Reviews” link that appears on the AirportWorker website for a link to guidelines for writing and posting member reviews. You understand and agree that we may, but are not obligated to, review the content and may delete or remove it (without notice) in our sole and absolute discretion for any reason or no reason. Please also see “Use of Information Submitted” below.

WHEN YOU HAVE SUBMITTED A REVIEW, WE WILL DISPLAY YOUR RATING OF JOB POSTINGS & RESUMES. BY SUBMITTING A REVIEW, YOU UNDERSTAND AND AGREE THAT YOU ARE CONSENTING TO THE RELEASE OF ALL INFORMATION PROVIDED IN YOUR REVIEW, INCLUDING YOUR RATING OF A JOB POSTING OR RESUME, TO A PUBLIC FORUM, INCLUDING OTHER MEMBERS OF, AND VISITORS TO, THE AirportWorker SERVICE. IF YOU DO NOT WANT YOUR REVIEWS TO BE SHARED IN A PUBLIC FORUM, DO NOT USE THE REVIEW FEATURE.

Use of the Reviews feature is for your personal, non-commercial use and is at your own option and risk. The Reviews feature may change without notice to you, and the degrees of associated information sharing and functionality may also change without notice.

User Name and Password

The member who created the AirportWorker account and whose Payment Method is charged is referred to here as the Account Owner. The Account Owner has access and control over the AirportWorker account. The Account Owner’s control is exercised through the use of the Account Owner’s password, and therefore, to maintain exclusive control, the Account Owner should not reveal the password to anyone. In addition, if the Account Owner wishes to prohibit others from contacting AirportWorker Customer Service and potentially altering the Account Owner’s control, the Account Owner should not reveal the Payment Method details (e.g., the last four digits of their credit or debit card or their email address) associated with their account.

THE USERNAME AND PASSWORD ISSUED WILL BE REQUIRED TO ACCESS THE SERVICE. MEMBERS MAY ACCESS THE SERVICE ONLY USING THEIR USERNAME AND PASSWORD AND MAY NOT ALLOW ANY OTHER PERSON TO ACCESS THE SERVICE USING THEIR USERNAME OR PASSWORD. MEMBERS ARE SOLELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF THEIR PASSWORD AND FOR ALL USE, WHETHER AUTHORIZED OR UNAUTHORIZED, OF THE SERVICE UNDER THEIR USERNAME AND PASSWORD. AIRPORTWORKER SHALL HAVE NO OBLIGATION WITH REGARD THERETO. MEMBERS MUST PROMPTLY INFORM AIRPORTWORKER IF THEY SUSPECT ANY BREACH OF SECURITY, SUCH AS LOSS, THEFT, OR UNAUTHORIZED DISCLOSURE OR USE OF ANY USER NAME, PASSWORD, OR CREDIT CARD NUMBER USED IN CONNECTION WITH THE SERVICE. UNTIL THE COMPANY IS PROPERLY NOTIFIED OF A BREACH OF SECURITY, THE MEMBER WILL REMAIN RESPONSIBLE FOR ANY UNAUTHORIZED USE OF THE SERVICE OCCURRING UNDER THE MEMBER’S USERNAME AND PASSWORD. LIABILITY FOR UNAUTHORIZED USE OF YOUR CREDIT CARD IS SUBJECT TO YOUR AGREEMENT WITH YOUR CREDIT CARD COMPANY.

Parental Controls

Please note the AirportWorker service is not intended to be used by children without the involvement, supervision, and approval of a parent or legal guardian. Therefore, the Account Owner should not reveal the account password to the child.

Feeds

Members from certain countries may have access to RSS feeds as a convenient way to receive information about AirportWorker content that is publicly available on the AirportWorker site to your RSS reader or an RSS-associated website of your choice. RSS stands for Really Simple Syndication. It allows information to be published in a standard XML format that can be accessed via a URL. AirportWorker may also choose, at any time, to provide feeds in other formats, such as Atom. All use of the RSS and other feeds (“Feeds”), including obtaining a Feed from the AirportWorker website, receiving it into an application or website, or displaying the content received from such Feeds, is at your own option and risk and is covered by the Terms of Use for the AirportWorker Feeds. By using the AirportWorker Feeds, you agree to be bound by the Terms of Use for AirportWorker Feeds. In particular, you acknowledge and agree that you are consenting to the information being transferred to the location of the Feed as enabled by you and that your use of a Feed may cause personally identifying information to be associated with you, even if such information is not provided by the Feed.

Applications

You may encounter third-party Applications (including, without limitation, websites, widgets, software, or other software utilities) (“Application(s)”) that interact with the AirportWorker service. These Applications may import data related to your AirportWorker account and activity and otherwise gather data from you. These Applications are provided solely as a convenience to you, and AirportWorker is not responsible for and does not endorse the content of such Applications. SUCH APPLICATIONS ARE OWNED OR OPERATED BY THIRD PARTIES THAT ARE NOT RELATED TO, ASSOCIATED WITH, OR SPONSORED BY AirportWorker AND MAY NOT BE AUTHORIZED FOR USE WITH OUR SERVICE IN ALL COUNTRIES. Some of these Applications may even use AirportWorker trademarks. Unless otherwise noted by AirportWorker on the AirportWorker website, AirportWorker is not responsible for and does not endorse the content of such Applications. You will need to make your own independent judgment regarding your interaction with these Applications. If you choose, at your sole and absolute discretion and risk, to use an Application, such Application may interact with, connect to, or gather and/or pull information from and to your AirportWorker account. By using such Applications, you acknowledge and agree to the following: (i) if you use an Application to share information relating to your AirportWorker account, you are consenting to the information about your account being shared; (ii) your use of an Application may cause personally identifying information to be publicly disclosed and/or associated with you, even if AirportWorker has not provided such information; and (iii) your USE OF AN APPLICATION IS AT YOUR OWN OPTION AND RISK, and you will hold AirportWorker harmless for the sharing of information relating to your AirportWorker account that results from your use of an Application. You must read all log-in boxes and other pop-up boxes closely for notices about sharing your AirportWorker account information with, through, or by any other means identified on an Application. In addition, the Application’s end user license agreement, terms of use, and/or any other documentation or materials designated by the Application will govern your use of that Application. It is possible that you may be able to revoke an Application’s access to your AirportWorker account at any time, but information shared prior to revocation may continue to be viewable within, or otherwise continue to be used by, the Application depending on the policies of such Application. If you have any questions, concerns, complaints, or claims about the Applications, you should contact the support or contact personnel of the Application and not AirportWorker unless otherwise indicated by AirportWorker. AirportWorker DISCLAIMS ALL LIABILITY ARISING FROM YOUR USE OF APPLICATIONS.

Account Access and Identity Protection

In order to provide you with ease of access to your account and to help administer the AirportWorker service, AirportWorker implements technology that enables us to recognize you as the account holder and provide you with direct access to your account without requiring you to retype any password or other user identification when you revisit the AirportWorker service. You are responsible for updating and maintaining the truth and accuracy of the information you provide to us relating to your account.

You are also responsible for maintaining the confidentiality of your account and password and for restricting access to your AirportWorker account. If you disclose your password to anyone or share your account and/or devices with other people, you take full responsibility for their actions. Where possible, users of public or shared devices should log out at the completion of each visit. If you sell or return an Internet-enabled device, you should log-out and/or deactivate the device before doing so. Similarly, if your Internet-enabled device is lost or stolen, please deactivate the Internet-enabled device. If you fail to log out or deactivate your device, subsequent users may access the AirportWorker service through your account and may be able to access your account information.

If you find that you’re a victim of identity theft and it involves an AirportWorker account, you should notify Customer Service. Then, you should report this instance to all your card issuers, as well as your local law enforcement agency. Also, you should be mindful of any communication requesting that you submit credit card or other account information. Providing your information in response to these types of communications can result in identity theft. Always access your sensitive account information by going directly to the AirportWorker website and not through a hyperlink in an email or any other electronic communication, even if it looks official. AirportWorker reserves the right to place any account on hold anytime, with or without notification to the member, in order to protect itself and its partners from what it believes to be fraudulent activity. AirportWorker is not obligated to credit or discount a membership for holds placed on the account by either a representative of AirportWorker or by the automated processes of AirportWorker.

Disclaimers of Warranties and Limitations on Liability

THE AirportWorker SERVICE, INCLUDING OUR WEBSITE AND USER INTERFACES, AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH, OR ANY OTHER FEATURES OR FUNCTIONALITIES ASSOCIATED WITH THE AirportWorker SERVICE, ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE AND OUR LICENSORS MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WITH RESPECT TO THE AirportWorker SERVICE, OUR WEBSITE AND USER INTERFACES, AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH. AirportWorker DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE AirportWorker SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, AND YOU AGREE THAT AirportWorker MAY ELIMINATE OR OTHERWISE MODIFY ANY OR ALL ASPECTS OF THE AirportWorker SERVICE, INCLUDING FEATURES, WITHOUT COMPENSATION OR NOTICE TO YOU. We do not represent or guarantee that your use of the AirportWorker service will be free from interruption, loss, corruption, attack, viruses, interference, hacking, or other security intrusion, and we disclaim any liability with respect thereto. No oral or written information or advice given by us or our authorized representative shall create a warranty or otherwise constitute a representation binding upon AirportWorker or its affiliated parties.

AIRPORTWORKER IS NOT AN EMPLOYMENT AGENCY, AND NO GUARANTEE OF EMPLOYMENT OR CANDIDATE PLACEMENT IS EXPRESSED OR IMPLIED. AIRPORTWORKER SERVICE IS PROVIDED FOR ENTERTAINMENT PURPOSES ONLY AND IS AN AT-WILL, SELF-SERVICE. AIRPORTWORKER DOES NOT WARRANT THAT SERVICES, FUNCTIONS, AND INFORMATION PROVIDED WILL GUARANTEE APPLICANT OR CANDIDATE INTERVIEWS, PLACEMENT, OR ACHIEVE FULFILLMENT OF POSTED VACANCIES.

The AirportWorker service, including all content included on the AirportWorker website and user interfaces or delivered to members as part of the service, including, but not limited to, job postings, resumes & email communications, text, graphics, logos, designs, photographs, button icons, images, audio/video clips, digital downloads, data compilations, and software, are the property of AirportWorker or its licensors and are protected by United States and international copyright, trade secret or other intellectual property laws and treaties. The compilation of all content and any software or other materials provided by AirportWorker on our website and user interfaces or in connection with the AirportWorker service are the exclusive property of AirportWorker and its licensors and are protected by the copyright and trade secret laws in the territories in which the AirportWorker service operates and by international treaty provisions. Content shall not be reproduced or used without express written permission from AirportWorker or its licensors. You agree to adhere to the restrictions set forth under “AirportWorker Hosting Service” and “Limitations on Use.” You agree not to decompile, reverse engineer, or disassemble any software or other products or processes accessible through the AirportWorker service, not to insert any code or product or manipulate the content of the AirportWorker service in any way, and not to use any data mining, data gathering or extraction method. AirportWorker reserves the right to terminate your membership hereunder if AirportWorker, in its sole and absolute discretion, believes that you are in violation of AirportWorker software restrictions, restrictions against copying job postings, resumes & content provided to you by us, or other unauthorized copying or use of our proprietary content in violation of the copyrights of AirportWorker and its licensors. AirportWorker does not promote, foster, or condone the copying of job postings or resumes or any other infringing activity. The use of the AirportWorker service, including job postings & resumes made available to you by us, is solely for your personal and non-commercial use. Please see the instructions at the end of these Terms of Use for notifying us of the presence of any allegedly infringing content of the AirportWorker service, including any on the AirportWorker website and user interfaces.

AirportWorker is a registered trademark of Airport Media, Inc. The AirportWorker logo and AirportWorker.com are trademarks or service marks of Airport Media, Inc.. The AirportWorker website and user interfaces, including but not limited to its graphics, logos, page headers, button icons, scripts, and service names, constitute the trade dress of Airport Media, Inc. The trademarks, service marks, and trade dress of AirportWorker may not be used or reproduced without prior written approval from AirportWorker and may not be used in connection with any product or service that is not affiliated with AirportWorker, in any manner that is likely to cause confusion among customers, in any manner that dilutes the rights of AirportWorker, or in any manner that disparages or discredits AirportWorker. Other trademarks that appear on the AirportWorker website and user interfaces are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by AirportWorker. Entertainment and Service Content

We distribute job postings, resumes, and other employment information, and we reserve the right to display and promote other information through our service, including our website and user interfaces, to you in any manner we choose at our sole and absolute discretion. In addition, the AirportWorker service allows you and other third parties to post reviews or comments concerning the content distributed by us. Any opinions, advice, statements, services, offers, or other information that constitutes part of the content expressed or made available by third parties through the AirportWorker service are those of the respective authors or producers and not of AirportWorker or its shareholders, directors, officers, or employees or licensors. Under no circumstances shall AirportWorker, or its shareholders, directors, officers, directors, employees, or licensors be held liable for any loss or damage caused by your reliance on information obtained through the AirportWorker service. It is your responsibility to evaluate the information, opinion, advice, or other content available through the AirportWorker service.

Use of Information Submitted

AirportWorker is free to use any job postings, resumes, comments, information, ideas, concepts, reviews, techniques, or any other material contained in any communication you may send to us (“Content”), including responses to questionnaires or through postings to the AirportWorker service, including the AirportWorker website and user interfaces, without further compensation, acknowledgment or payment to you for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products, sharing through social media and creating, modifying or improving the AirportWorker service. Furthermore, by posting any Content on our site, submitting Content to us, or responding to questionnaires, you grant us a perpetual, worldwide, non-exclusive, royalty-free irrevocable license, including the right to sublicense such right, and right to display, use, reproduce or modify the Content submitted in any media, software or technology of any kind now existing or developed in the future.

Please note that AirportWorker does not accept unsolicited materials or ideas for use or publication and is not responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to AirportWorker. Should you send any unsolicited materials or ideas, you do so with the understanding that no additional consideration of any sort will be provided to you, and you are waiving any claim against AirportWorker and its affiliates regarding the use of such materials and ideas, even if the material or an idea is used that is substantially similar to the idea you sent.

Service Testing

From time to time, we test various aspects of our service, including our website, user interfaces, service levels, plans, promotions, features, availability of job postings & resumes, delivery, and pricing, and we reserve the right to include you in or exclude you from these tests without notice.

Customer Service

If you need assistance with your account, you may find answers and reach Customer Service at any time through the Help Center, where you will find the answers to many frequently asked questions and information on reaching a live Customer Service Representative.

In certain instances, Customer Service may best be able to assist you by using a remote access support tool, which will enable us to interact directly with your account. We provide such support service only with your permission and in your presence (via phone and Internet connection). During the time we are providing you with remote access support service, we have full access to your desktop. If you do not want us to have this access, you should not consent to support through the remote access tool, and we will do our best to assist you through other means. The Disclaimers of Warranties and Limitations of Liability set forth in these Terms of Use expressly apply to the use of Customer Service, including any remote desktop access tool. Your Conduct in Accessing the AirportWorker Service

By accessing the AirportWorker service, including the AirportWorker website and user interfaces, you agree to use the AirportWorker service, including all features and functionalities associated therewith, the website and user interfaces, and all content and software associated therewith in accordance with all applicable laws, rules, and regulations, including public performance limitations or other restrictions on use of the service or content therein. In addition, you agree not to upload, post, e-mail, or otherwise send or transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware, or telecommunications equipment associated with the AirportWorker service. You also agree not to impersonate any other person while using the AirportWorker service, conduct yourself in a vulgar or offensive manner while using the AirportWorker service, or use the AirportWorker service for any unlawful purpose.

You agree that all of the foregoing restrictions apply not only to the AirportWorker service but also to the servers and networks connected to any portions of the AirportWorker service, whether operated by AirportWorker or third parties (“Networks”). You agree not to interfere with Networks, violate any of the procedures, policies, or regulations applicable to Networks, use Networks in a way that harms or impairs anyone else’s use of Networks, use Networks to gain unauthorized access to any service, data, account or other networks, use Networks to falsify any protocol or email header information (e.g., “spoofing”), use Networks to send “spam” (i.e., unsolicited bulk email or commercial messages) or items of a destructive or deceptive nature, or remove, modify, or tamper with any regulatory or legal notice or link that is incorporated into Networks.

Limitations on Use

You must be 18 years of age or older to become a member of the AirportWorker service. In certain jurisdictions, the age of the majority may be older than 18, in which case you must satisfy that age in order to become a member. While individuals under the age of 18 may utilize the service, they may do so only with the involvement of a parent or legal guardian, under such person’s account and otherwise subject to these Terms of Use. While AirportWorker does distribute products that may be used by children, the AirportWorker service is not intended to be used by children without the involvement, supervision, and approval of a parent or legal guardian (see also “Parental Controls”). Unless otherwise specified, the AirportWorker service and any content viewed through our service are for your personal and non-commercial use only, and we grant you a limited, non-exclusive, non-transferable license to access the AirportWorker service for that purpose. Except for the foregoing limited license, no right, title, or interest shall be transferred to you. You may not download (other than through page caching necessary for personal use or as otherwise expressly permitted by these Terms of Use), modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from, or offer for sale any information contained on, or obtained from or through, the AirportWorker service, without our express written consent. AirportWorker does not promote, foster, or condone the copying of job postings, resumes, digitally delivered content, or any other infringing activity. You may not circumvent, remove, alter, deactivate, degrade, or thwart any of the content protections in the AirportWorker service. You may not frame or utilize any framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of AirportWorker without our express written consent. In addition, other websites may link to the AirportWorker website, or AirportWorker may include links to the websites of businesses, including those that have associations with us through certain programs. For example, AirportWorker may include pages that display and provide information on Applications or other products. These pages may provide links to third-party sites where AirportWorker members may obtain or purchase such Applications and products. AirportWorker has not reviewed these websites and is not responsible for the offerings of any of these sites or the content, privacy policies, or terms of use of these websites or Applications. You acknowledge and agree that AirportWorker is not responsible or liable for, and does not otherwise warrant, the actions of these third parties, the products or contents on their websites, or the performance of any Applications and devices. Promotions

Unless otherwise noted, promotion codes can only be used once and cannot be redeemed for cash, resold, or combined with any other offers, including free trials. If you received a promotion code through an offer by a third party, additional restrictions may apply, and it is your sole responsibility to know the rules set forth in any discount or promotion when claiming eligibility. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the state of New York, U.S.A., without regard to conflict of laws provisions. If any provision or provisions of these terms shall be held to be invalid, illegal, unenforceable, or in conflict with the law of any jurisdiction, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby, and shall remain in full force and effect. No action of any kind or nature arising out of this Agreement, or out of any use of the Service, shall be brought by either AirportWorker or any user more than one year after the date on which the cause of action first arises. Judgment upon the award rendered by the court may be entered in and enforced by, and each party to this Agreement submits to the exclusive jurisdiction of the state and federal courts sitting in Nassau County, New York, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. In any proceeding or action to enforce the court’s award, the prevailing party will be entitled to costs and attorneys’ fees.

Failure by AirportWorker to enforce any provision(s) of this Agreement shall not be construed as a waiver of any provision or right.

These Terms of Use constitute the entire agreement between you and AirportWorker with respect to the Service and supersedes all prior agreements or understandings between you and the AirportWorker with respect thereto.

Loss and/or Damage

The member is responsible for all loss and damage incurred by Airport Media, Inc. where such loss and/or damage is caused by misuse or abuse of the Service, including but not limited to violation of the Terms of Use, or copying and/or redistribution of any or all site content for profit or non-profit. Violators are immediately subject to a $1,000.00 per incident fine. The member is responsible for all additional costs incurred by Airport Media, Inc. including but limited to court costs, processing fees, and travel and expenses incurred to rectify the situation. Should you decide to take AirportWorker to court, the maximum amount of damages is limited to the total amount of funds you have paid AirportWorker. The member is responsible for paying said fine(s) and fee(s). Fines are non-refundable.
